Haikou released a new policy of buying houses and adjusting talents’ settlement: implementing a global non-differential purchase restriction.

  On September 18th, official website, Housing and Urban-Rural Development Bureau of Haikou City, Hainan Province, showed that the Office of Haikou Municipal People’s Government issued the Notice on Adjusting the Policies of Buying Houses and Resettlement of Talents in Haikou City (hereinafter referred to as the Notice) to adjust the policies of purchasing commercial housing and talents in Haikou City.

  

  Regarding the promulgation of the Notice, the Haikou Municipal Government explained that in order to thoroughly implement the central government’s positioning spirit of "housing, living and not speculating", earnestly fulfill the main responsibility of real estate regulation and control cities, and improve the accuracy of regulation and control policies and measures, the relevant policies for purchasing houses and settling in talents should be adjusted in a timely and appropriate manner from the reality of Haikou City, so as to promote the stable and healthy development of Haikou’s real estate market and realize the talent development strategy. The "Notice" moderately adjusted the purchase conditions of newly introduced talents and those who have not settled down, implemented the global non-differential purchase restriction, strengthened the housing control measures, and strengthened the purchase control of talents who have not really worked in Haikou, which is conducive to guiding settled talents to really work and start businesses in Haikou, stabilizing the supply and demand market, and striving to achieve the goals of stabilizing land prices, housing prices and stabilizing expectations.

  According to the New Deal, this policy adjustment is mainly in two aspects, one is to buy a house, and the other is to settle down with talents.

  There are four main contents in the policy adjustment of purchasing houses:

  First, newly settled talents must provide accumulated social security or tax payment records for 12 months before they can buy the first house in Haikou, and they can buy the second house after the first house has been filed for 36 months.

  Second, talents who have not settled down must provide accumulated social security or individual tax payment records for 24 months before they can buy a house in Haikou.

  The third is to implement the global purchase restriction, and those who are not talents in other provinces’ household registration must provide accumulated social security or individual tax payment records for 60 months before purchasing a house in Haikou.

  Fourth, divorced people, if any party purchases commercial housing within 3 years from the date of divorce, the number of houses owned by them is calculated according to the total number of houses owned by families in Hainan Province before divorce.

  In terms of talent settlement, it shall be implemented in accordance with the relevant provisions of the Notice of Hainan Provincial People’s Government on Printing and Distributing the Implementation Measures for Introducing Talents to Settle in Hainan Province (Qiong Fu [2017] No.66). The conditions for settling down are: college degree or above, under 40 years old (of which the bachelor degree or above in 985 and 211 colleges is under 55 years old); Those with intermediate professional skills and above technical titles, technicians and above professional qualifications are under 40 years of age; Get employed first and then settle down.

  For the A, B, C, D, E high-level talents recognized by provincial departments such as the Talent Development Bureau of the Provincial Party Committee and those who have settled down before the implementation of the policy, the original housing purchase policy will remain unchanged.

  The following is the policy interpretation of the Notice on Adjusting the Housing Purchase Policy and the Talent Settlement Policy in our city.

  Q: 1. What is the purpose of issuing the Notice on Adjusting the Housing Purchase Policy and the Talent Settlement Policy in our city (hereinafter referred to as the Notice)?

  A: The main purpose of the Notice is to thoroughly implement the spirit of the central government’s positioning of "housing, living and not speculating", earnestly fulfill the main responsibility of real estate regulation and control of cities, improve the accuracy of regulatory policies and measures, and timely and appropriately adjust the relevant policies on housing purchase and talent settlement from the actual situation of our city, so as to promote the stable and healthy development of our real estate market and realize the talent development strategy. The "Notice" moderately adjusted the purchase conditions of newly introduced talents and those who have not settled down, implemented the global non-differential purchase restriction, strengthened the housing control measures, and strengthened the purchase control of talents who have not really worked in our city, which is conducive to guiding settled talents to really work and start businesses in our city, stabilizing the supply and demand market, and striving to achieve the goals of stabilizing land prices, housing prices and expectations.

  Q: Second, after the implementation of the Notice, who has adjusted the purchase policy?

  Answer: (1) Talents newly settled in our province (excluding high-level talents)

  The original policy is: from the date of settlement in our province, you can buy commercial housing and enjoy the same treatment as local residents, so you can buy 2 sets of housing.

  The current policy is as follows: (1) I can only buy the first house (including second-hand housing, excluding property hotel, the same below) in our city if I provide my social security or individual tax payment records for 12 months or more in our province; After the first set of housing purchase contract has been filed for 36 months, the second set of housing can be purchased.

  The newly settled talents from the date of implementation of the "Notice", whose families have one set of housing in this province, must provide their social security or tax payment records accumulated for 12 months or more in our province before purchasing another set of housing; If there are 2 or more houses, you can’t buy any more houses.

  (two) talents who have not settled in our province (talents who have actually worked in our province but have not yet settled)

  The original policy is: at least one family member has paid social security or individual tax for 12 months or more in our province, and there is no self-owned house in our province, so he can buy one house in our province.

  The current policy is: I must provide the social security or individual tax payment records accumulated for 24 months or more in our province, and I don’t have my own house in our province before I can buy a house in our city.

  (3) Persons who are not registered in this province.

  The original policy is: if you buy a house in the restricted area of our city, you should provide the social security or tax payment record of at least one family member who has accumulated in our province for 60 months or more; If you buy a house outside the restricted purchase area, you can provide the social security or individual tax payment record of at least one family member in our province for 24 months or more, and if you don’t have your own house in our province, you can buy one house in our city.

  The current policy is: no longer distinguish between restricted and non-restricted areas. Anyone who buys a house within the administrative area of our city must provide the social security or individual tax payment record of at least one family member in our province for 60 months or more, and there is no self-owned house in our province before buying a house in our city.

  (4) Divorced persons

  The original policy was not restricted.

  The current policy is: if the husband and wife are divorced and either party purchases commercial housing within 3 years from the date of divorce, the number of housing units owned by them shall be calculated according to the total number of housing units owned by families in our province before divorce. That is, divorced people after the implementation of the Notice, whether they are qualified to purchase houses within 3 years from the date of divorce depends on the total number of houses owned by families before divorce. If they do not meet the number of houses stipulated in their applicable purchase policies, they can purchase houses within the policy scope; If you have reached or exceeded the number of sets stipulated in the applicable purchase policy, you can no longer buy a house.

  The time of divorce shall be based on the registration date of divorce certificate or the date determined by effective legal documents. If you remarry after divorce, the housing purchase restriction policy will be implemented with the new family as the unit. If the divorce registration procedures have been completed before the implementation of the Notice, the original policy shall prevail.

  Q: 3. Who will not adjust the purchase policy?

  A: 1. Residents who settled in this province before April 22, 2018 (including April 22);

  2. Residents who settled in this province after April 22, 2018 and before the implementation of the Notice;

  3. All kinds of talents who have settled before the implementation of the Notice;

  4. All kinds of recognized high-level talents (A, B, C, D, E);

  5. The talents of headquarters enterprises, investment projects enterprises and institutions and institutions shall continue to be implemented in accordance with the relevant provisions of the Notice of Haikou Housing and Urban-Rural Development Bureau, the Talent Development Bureau of Haikou Municipal Committee of the Communist Party of China and the Haikou Municipal Bureau of Commerce on Printing and Distributing the Implementation Rules for Implementing the Supplementary Notice on Improving the Housing Policy for Talents of the Provincial Housing and Urban-Rural Development Department and the Talent Development Bureau of the Provincial Party Committee (Hai Zhu Jian Fa Bei Zi [2019] No.1).

  Q: 4. Talents who have not settled in our province and those who are not registered in our province have obtained the qualification code for purchasing houses before the implementation of the Notice, but have not yet purchased houses. Can they continue to purchase houses after the implementation of the Notice?

  A: Talents who have not settled in our province and those who are not registered in our province have obtained the qualification code for purchasing houses before the implementation of the Notice, but they have not yet purchased houses, which shall be implemented according to the Notice. That is, after the implementation of the "Notice", if it meets the provisions of the "Notice", the purchase qualification code is still valid; If it does not meet the requirements of the Notice, the purchase qualification code will be cancelled.

  Q: Is the New Deal applicable to those who have signed a house purchase agreement or subscription before the implementation of the Notice and paid the relevant house price?

  A: In order to ensure the smooth convergence of policies, it will not affect the households who have entered the process of purchasing houses to complete the procedures for filing the purchase contract and registering the real estate. For those who have submitted the contract for filing or completed the filing of the purchase contract before the implementation of the Notice, the original policy will continue to be applied to complete the contract filing and registering the real estate; Before the implementation of the Notice, if the contract has not been submitted for record, but the purchase agreement (or subscription book) has been signed and the house price (including deposit and down payment) has been paid, and it is in line with the housing purchase restriction policy in the corresponding period, the purchase contract record and real estate registration procedures can be continued with the purchase agreement (or subscription book), bank transfer voucher (excluding cash payment) and other materials.

  Q: Before the implementation of the Notice, those who have applied for talents to settle down but have not obtained the Certificate of Permission to Move in or have obtained the Certificate of Permission to Move in but have not moved into the household registration in our city, how can they go through the settlement procedures after the implementation of the policy?

  A: Those who have applied for talents to settle down before the implementation of the Notice, but have not obtained the Certificate of Permission to Move in, shall be implemented according to the Notice; Before the implementation of the "Notice", the certificate of permission to move in has been obtained, but it has not yet moved into the household registration in our city, and the settlement procedures shall be handled according to the original policy.

  Q: How to implement the policy of purchasing houses for talents (excluding high-level talents) who have applied for talents to settle down before the implementation of the Notice but obtained household registration certificates in this province after the implementation of the policy?

  A: The date recorded in the Permit to Move in shall prevail. After the implementation of the Notice, it shall be implemented according to the Notice.
