Do not conform to the provisions of the property regulations, Beijing abolished these documents! Property charges, etc.

  On December 14th, the Beijing Municipal Commission of Housing and Urban-Rural Development issued the Notice on Abolishing Some Property Management Documents, which abolished 12 property management documents. It is reported that the abolished documents are inconsistent with the provisions of the Beijing Property Management Regulations, including property service charges, supporting documents of the Beijing Property Management Measures, and credit information management of property service enterprises.

  On May 1, 2020, the Regulations of Beijing Municipality on Property Management (hereinafter referred to as the Regulations) was officially implemented, and the property management system under the framework of community governance led by party construction in this city was basically formed. Recently, the Municipal Housing and Urban-Rural Development Committee has cleaned up the relevant documents in the field of property management in combination with the actual situation of the current grass-roots property management work. The contents of 12 documents in the field of property management have been inconsistent with the relevant provisions of the Regulations, so it was decided to abolish them.

  Specifically, there are three abolished documents related to property service charges, including the Notice on Defining the Scope of Property Management Charges for Housing Reform and Selling Houses, the Notice on Paying Property Service Charges for Selling Public Housing and Comfortable Housing according to the Housing Reform Policy, and the Notice on Issues Related to Property Service Charges for Affordable Housing. It is understood that the provisions of the above three documents are inconsistent with the provisions of Article 73 of the Regulations that "Beijing property service charges are subject to market adjustment and timely adjustment".

  The Municipal Commission of Housing and Urban-Rural Development said that after the above-mentioned documents are abolished, the owners need to pay the property fees according to the property service contract signed with the property service enterprises, which involves the adjustment of property service methods, service contents, service standards and service prices, and the owners will jointly decide by convening the owners’ meeting.

  In addition, seven supporting documents related to the Beijing Property Management Measures were abolished, including the Notice on Printing and Distributing the Opinions on Promoting the Construction of the Owners’ Congress in Residential Areas and the Notice on Promoting the Decision-making of Community Common Matters by Mobile Phone Voting. These seven documents are based on the Measures of Beijing Municipality on Property Management, which was abolished on June 8, 2020, so the corresponding documents were also abolished. For the relevant work involved in the above documents, the Municipal Housing and Urban-Rural Development Committee has formulated corresponding supporting policies in combination with the implementation of the Regulations, and the specific work will be implemented according to the new supporting policies.

  The abolished documents also involved two pieces of credit information management of property enterprises, namely the Notice on Printing and Distributing the Measures for the Management of Credit Information of Beijing Property Service Enterprises and the Notice on Strengthening the Management of Credit Information of Property Services. It is reported that these two documents are also based on the "Beijing Property Management Measures".

  In addition, the Municipal Commission of Housing and Urban-Rural Development said that in order to further protect the legitimate rights and interests of property management-related subjects in accordance with the law, the residential property management projects in this city have been included in the pilot reform of comprehensive supervision in 2022, and the city is continuing to build the supervision system of residential property management projects based on "credit+risk", and the credit management involving property enterprises will be implemented in accordance with the comprehensive supervision implementation plan.
